Robert practices in the Regulatory and Litigation practice groups with an emphasis in commercial/real estate litigation, mortgage litigation and compliance, and title insurance law. Robert's practice focuses primarily on two industries: mortgage and title insurance.

Robert's representation of mortgage companies is both trial practice and compliance. The trial practice has led Robert to trial and appellate courts in over 18 different states from Florida to Connecticut, and from Virginia to New Mexico. These cases involve numerous causes of action including TILA, HOEPA, FDCPA, FCRA, RESPA, RICO, predatory lending, mortgage related fees and services, insurance packing, equity stripping, flipping, mortgage escrow practices and state deceptive trade practice laws. In addition, Robert found success utilizing mediation to resolve on-going litigation and pre-litigation matters.

On the compliance side, Robert counsels mortgage companies in the area of qualification and licensing, disclosure requirements, anti-predatory lending legislation and complying with the following federal statutes and regulations:

  • Truth In Lending Act ("TILA") (15 U.S.C. § 1601 et seq.);
  • Home Ownership Equity Protection Act ("HOEPA")(15 U.S.C. §§ 1602(aa), 1639, and 1641(d));
  • Equal Credit Opportunity Act ("ECOA")(15 U.S.C. § 1691 et seq.);
  • Fair Housing Act ("FHA") (42 U.S.C. § 3601 et seq.);
  • Community Reinvestment Act ("CRA")(12 U.S.C. § 2901 et seq.);
  • Fair Credit Reporting Act ("FCRA") (15 U.S.C. § 1681 et seq.);
  • Racketeer Influenced and Corrupt Organizations Act ("RICO")(18 U.S.C. § 1961 et seq.);
  • Real Estate Settlement Practices Act ("RESPA") (12 U.S.C. § 2601 et seq.)
